South Point man sentenced for littering

CHESAPEAKE — A South Point man pleaded guilty Monday to contaminating the recycling bins at the Sam’s Club-Walmart parking lot in Burlington.

Lawrence-Scioto Solid Waste Management officials said they hope others who are thinking of using the recycling bins as free waste disposal stations will think twice before doing the same thing.

Wallace Lively, 47, of 69 Township Road 1154, South Point, pleaded guilty to one count of littering in Lawrence County Municipal Court. Judge Donald Capper sentenced him to one year of probation and 30 hours community service.

He also fined Lively $200, assessed court costs of $110 and ordered him to pay the solid waste district $106.43 for the cost of decontaminating the dumpsters.

Litter control enforcement officer Steve Hileman said Lively had asked the judge if he could forego the community service because it would be inconvenient, a proposal Capper nixed.

“The judge told him, ‘it is meant to inconvenience you.’” Hileman said.

Dan Palmer, director of the solid waste management district, said while he is pleased with the number of people who recycle and who use these containers, he is distressed that some people use the containers for purposes other than recycling.

“We’ve got to put a stop to this,” Palmer said.

Hileman said Lively was caught putting hydraulic hoses and household waste in the recycling containers.

Lively is the latest in a string of people charged with using the solid waste recycling bins as personal dumpsters.

The solid waste district has a couple dozen recycling containers scattered throughout the county as incentives to encourage people to recycle paper, plastic (beverage bottles, milk and juice jugs, liquid detergent bottles, trash bags, etc.), aluminum, glass and steel cans.

In addition to the containers at the Sam’s Club-Walmart lot in Burlington, there are also recycling containers at Lawrence County Municipal Court on County Road 1 in Chesapeake, the Perry Township Fire Department on County Road 1 in Sheridan, at Food Fair on State Route 7 in Proctorville, at Food Fair on Solida Road in South Point, at Sam’s Club in Burlington, at both stations of the Rome Township Volunteer Fire Department on State Route 7, at the Coal Grove Village Hall on Carlton-Davidson Lane and at the U.S. Forestry service office on State Route 93 in Elizabeth Township.
