New trial for man who killed MU player
CHARLESTON, W.Va. (AP) — The West Virginia Supreme Court has ordered a new trial for a Charleston man convicted in the fatal shooting of former Marshall University football player Donte Newsome.
The court on Thursday overturned the conviction of Jerel Addison Garner on charges of voluntary manslaughter, wanton endangerment and a concealed weapons violation. Garner was sentenced to up to 25 years in prison.
Newsome was shot outside a Huntington nightclub in 2008.
The high court said its ruling is based on the issue of Garner’s right to effectively cross-examine a key witness. The court said Garner’s Sixth Amendment right of confrontation was denied in ordering a new trial.
Newsome was originally from Chesapeake, Va. He lettered at linebacker at Marshall from 2002 to 2005.
McGahee may not play due to injury
BEREA (AP) — Browns starting running back Willis McGahee is not practicing because of an unspecified injury.
McGahee, who was not on Wednesday’s injury report, rode a stationary bike and worked with a trainer on the side of the field Thursday as the Browns continued preparing for Sunday’s game in Green Bay. His injury is not yet known.
Cleveland signed McGahee on Sept. 20, a day after the Browns traded running back Trent Richardson to Indianapolis. McGahee has rushed for 164 yards and one touchdown since joining the Browns.
He gained 37 yards last week in a loss to Detroit, giving him 8,621 career yards, fourth most among active players.
If McGahee can’t play, the Browns will likely start fullback Chris Ogbonnaya at tailback with Bobby Rainey and Fozzy Whitaker as his backups.
ND forward Auguste suffers broken hand
SOUTH BEND, Ind. (AP) — Notre Dame forward Zach Auguste is expected to miss four to six weeks with a broken left hand.
Auguste played in 25 games last season as a freshman, averaging 3.7 points, 2.7 rebounds and 10.7 minutes a game. The school said he fractured the hand last week and X-rays this week confirmed the break.
Coach Mike Brey called the injury unfortunate, saying he expects the 6-foot-10 Auguste to be a key player for the Irish this season. Notre Dame opens the season Nov. 8 against Miami of Ohio.
Ex-NFL star Fryar, mother indicted
NEWARK, N.J. (AP) — Former NFL player Irving Fryar and his mother were indicted by a New Jersey grand jury Wednesday on charges they conspired to steal more than $690,000 through a mortgage scam.
In announcing the indictment, prosecutors said Fryar and his mother, Allene McGhee, engaged in a “sophisticated mortgage fraud scam” by allegedly having McGhee submit false information to obtain five loans on her home within a six-day period. The two were indicted on counts of conspiracy and theft by deception.
The 51-year-old Fryar, of Springfield, N.J., is pastor of a church he founded and the head coach of the Robbinsville High School football team. His 72-year-old mother lives in Willingboro. The former wide receiver played for four NFL teams between 1984 and 2000, including the New England Patriots and the Philadelphia Eagles.
Nicklaus returning to play PNC Father-Son
ORLANDO, Fla. (AP) — Jack Nicklaus is returning to the PNC Father-Son Challenge with his oldest son.
Nicklaus and Jack Nicklaus II will be among 20 teams that play Dec. 12-15 at the Ritz-Carlton Golf Club. Nick Price and his son (Greg) and Stewart Cink and his son (Connor) will be playing for the first time.
The event is for players who have won a major or The Players Championship and a son — with a few exceptions. Two-time Masters champion Bernhard Langer and two-time major winner Fuzzy Zoeller will be playing with their daughters.
Nicklaus won the Father-Son in 1999 with Gary.
Only two players — Raymond Floyd and Larry Nelson — have won the tournament with different sons.
