Appeals court to hear superintendent case

CINCINNATI - The Ohio Fourth District Court of Appeals is scheduled to hear arguments Wednesday in the appeal of a lower court's decision to reinstate Lloyd Evans as superintendent of the Rock Hill School District.

The school board opted to non-renew Evans' contract in February 2004, but Evans successfully sued the district in Lawrence County Common Pleas Court and was returned to his job later that year. The board then filed an appeal.

Aaron McHenry, administrator for the fourth district, said each side will be given 15 minutes to present their argument before a three judge panel.

While the arguments may be short, the decision process will undoubtedly take longer.

"It could be up to three months, shorter or longer," McHenry said. "It depends on how complex the case is."

Calls were placed to both attorneys in the matter, G. Ross Bridgman, who represents the school district and David Kessler, who represents Evans. Neither returned

phone calls.
