Man sent to prison for 5 years

A Coal Grove man avoided a kidnapping charge, but will spend time in prison following an incident involving the custody of a child.
A first-degree charge of kidnapping was dismissed Wednesday in Lawrence County Common Pleas Court for Billy Darby, 37, of 131 Zoar Hill Road, Coal Grove, whose charges, according to prosecutors, arose from when he and another woman took their child from the child’s grandparents, who are the legal guardians.
Darby pleaded guilty to second-degree felonious assault, fourth-degree disrupting public service and misdemeanor theft.
Judge Charles Cooper sentenced the man to five years in prison.
In other cases:
• Wesley Plumley, 24, of 780 Boggs Road, Glenwood, West Virginia, was arraigned on a fifth-degree count of breaking and entering, to which he pleaded not guilty. Cooper continued bond from a lower court and ordered he undergo twice weekly drug tests. A pretrial was set for Sept. 21.
• Whitney Taylor, 30, of 125 Township Road 1161 Lot 16C, Proctorville, was arraigned on a count of misdemeanor possession of a controlled substance, to which she pleaded not guilty. Cooper continued bond from a lower court and set a pretrial for Sept. 21.
• Jonathon Eden, 42, of 84 Private Drive 8047, Proctorville, pleaded guilty to fifth-degree counts of breaking and entering and theft from a person in a protected class. Cooper ordered a presentence investigation and set sentencing for Sept. 21. Bond was modified to $25,000 own-recognizance.
• Michael Cook, 41, of South Point, admitted community control sanctions violations and was sentenced to five months in prison.
• Ryan Gilmer, 34, of 2095 Clendennin Road, Narrows, Virginia, was sentenced to three years in prison and a six-month driver’s license suspension. He previously pleaded guilty to two fifth-degree counts of possession of drugs, fifth-degree possession of heroin, and third-degree tampering with evidence.
• Kenneth France, 24, of 19 Williamsburg Drive, Barboursville, West Virginia, pleaded guilty to a fourth-degree count of trafficking in cocaine. Cooper ordered a PSI and set sentencing for Sept. 30.
• Amanda Ferrell, 34, of 513 Railroad St., Ironton, was sentenced to four year CCS under intensive supervised probation, in-house treatment at Mended Reeds and a six-month driver’s license suspension. She was also ordered to forfeit $5,645 that was in her possession at the time of her arrest. She previously pleaded guilty to fifth-degree possession of cocaine and possession of drugs.
• Clinton Cremeans, 36, of 433 Private Drive 856, South Point, was arraigned on fifth-degree counts of misuse of a credit card and receiving stolen property, fourth-degree theft from a protected class and two misdemeanor counts of theft, to which he pleaded not guilty.
Retired judge Richard Walton set bond at $25,000 OR and a pretrial was set for Sept. 21.
• Tony Wilson II, 25, of 1379 County Road 182, Kitts Hill, was arraigned on a third-degree count of illegal cultivation of marijuana, to which he pleaded guilty. Walton sentenced the man to nine months in prison and a six-month driver’s license suspension.
• Aaron Quinn, 30, of 1365 County Road 1 Apt. 13, South Point, admitted CCS violations and was sentenced to five months in prison.
• Michelle Curry, 35, of 103 Wilson Drive, Coal Grove, pleaded guilty to a fourth-degree count of trafficking in drugs. Walton sentenced the woman to nine months in prison and a six-month driver’s license suspension.
• Sarah Cherry, 21, of 1454 N. Calumet Drive, Worthington, Kentucky, who previously pleaded guilty to a fifth-degree count of possession of drugs, was sentenced to four years CCS/ISP, treatment at Mended Reeds, 200 hours community service and a six-month driver’s license suspension.
• Mickey Rowe, 45, of 291 County Road 7C, Ironton, was arraigned on two fifth-degree counts of misuse of a credit card, to which he pleaded not guilty. Walton set bond at $10,000 OR and set a pretrial for Sept. 21.
• Richard Young Jr., 32, of 2214 Davis Road, Crown City, was arraigned on counts of third-degree having weapons under a disability and misdemeanor aggravated menacing, to which he pleaded not guilty. Walton set bond at $25,000 cash or surety plus OR and set a pretrial for Sept. 14.
• Kayla Burke, 31, of 914 Walnut St., Ironton, admitted CCS violations and was sentenced to 10 months in prison.
• Paul Baldwin, 31, of 100 Hogett Hollow, Ironton, was arraigned on a fifth-degree and a misdemeanor count of public indecency, to which he pleaded not guilty. Walton set bond at $10,000 OR and a pretrial was set for Sept. 21.
• Betty Dement, 47, of 51 Township Road 1231, Proctorville, was arraigned on a third-degree count of tampering with evidence, to which she pleaded not guilty. Walton continued bond from a lower court and added $10,000 OR. A pretrial was set for Sept. 21.
• Jean Dodson, 35, of 3858 County Road 55, South Point, pleaded guilty to a count of burglary. Walton sentenced the woman to seven months in prison and ordered her to pay $319 in restitution.
