A 19-year-old Coal Grove man will spend seven years in prison for raping a 10-year-old boy.
Johnathan Kazee, of 727 High St., pleaded guilty to one count of first-degree rape Wednesday in Lawrence County Common Pleas Court.
Besides seven years in prison, Judge Charles Cooper also ordered that Kazee report as a Tier 3 sex offender for the rest of his life.
Kazee’s attorney, Warren Morford, told the court his client has lower than average intelligence and that he has expressed remorse for the crime.
The attorney had previously entered a plea of not guilty by reason of insanity on behalf of Kazee. However a mental health evalua tion found that Kazee is competent and was sane at the time of the offence.
Kazee apologized to the court.
“I’m very sorry for what I’ve done and, if I could, I’d take it back,” Kazee said. “I’m very sorry for this but I deserve what I get.”
In a separate case, John Dale Larsen Jr., 30, of 1173 County Road 1 Lot 1, South Point, pleaded guilty to second-degree robbery.
Larsen robbed a gas station in South Point with a BB gun, Assistant Prosecutor Brigham Anderson said.
Cooper sentenced the man to seven years in prison and ordered him to pay $177 in restitution to the BP station he robbed.
The man’s defense attorney, Phillip Heald, said Larsen regrets the crime.
“I would say that had he not chosen to confess, the facts were not sufficient to convict him in this,” Heald said.
Larsen also apologized for his actions.
In other cases Wednesday, Houston E. McClung III, 34, of 14542 State Route 7, pleaded guilty to aggravated vehicular assault, driver with a suspended license, operating a vehicle while intoxicated and disobeying a traffic control device.
The charges stem from a collision that resulted in the injuries of a family of three children and two adults.
All of the victims in the case were taken to a hospital following the accident in September. Cooper ordered a presentencing investigation to be done and scheduled sentencing to be Feb. 16.
Joshua A. Murrell, 24, of 411 Etna St., Ironton, pleaded guilty to a bill of information that included one count of theft, a fifth-degree felony. A bill of information differs from an indictment in that the charges are not presented to a grand jury.
Judge D. Scott Bowling sentenced Murrell to four years of community-controlled sanctions and ordered him to successfully complete the STAR community justice program.
Murrell was also ordered to pay $2,500 in restitution to Brown Funeral Chapel, the victim in the case.
Linda Neace, 38, of Greenup, Ky. plead guilty to third-degree theft. Cooper scheduled sentencing for Feb. 16.
