A local radio personality spent Wednesday night in jail after his defense attorney asked for more time before sentencing and a judge responded by terminating the man's bail.
James Steven Reinhardt, 50, of 149 Township Road 121, Proctorville, was scheduled to be sentenced Wednesday afternoon by Lawrence County Common Pleas Judge Richard Walton on charges of
burglary and menacing by stalking.
On Monday, Reinhardt's attorney, Marty Stillpass, called Walton and asked if the sentencing could be moved to a later date to allow him more time to bring in witnesses who would speak on Reinhardt's behalf before his client was sentenced. Walton told Stillpass he had granted numerous continuances in the past and would not do so again.
"The court feels that all these matters are delay tactics. On the matter of sentencing tomorrow will be one year. I've granted continuance after continuance after continuance in this case," Walton said. He rescheduled the sentencing for Oct 11.
Reinhardt was arrested in
September 2004 and his trial was originally scheduled for January of this year. It was moved twice at Stillpass' request. He pleaded guilty in July
and after a pre-sentence investigation a sentencing date was set Aug. 30.
Stillpass said he had tried to call Walton last week to reschedule but the judge was out of town. He protested Walton's decision to terminate Reinhardt's bond.
"Revocation of his bond is not necessary for his protection, or the protection of anyone else nor would it guarantee his presence in court," Stillpass said.
Stillpass refused to comment on the matter after court.
Assistant Lawrence County Prosecutor Bob Anderson said he had planned to recommend "the low end of
sentencing guidelines when Reinhardt is sentenced. Reinhardt faces 2 to 8 years on the second-degree burglary charge and 18 months in prison on each of the three counts of fourth-degree felony menacing by stalking.
Known as "Rhino" on the air, he was arrested outside the residence on a Rome Township woman last year by local authorities who were investigating stalking charges leveled by the victim, a woman in her early 20s.
The woman and her family told authorities someone had been leaving pornographic material in the woman's car many times over a period of several months and had even broken into their house.
