Man denies vehicular assault, OMVI charges

A Proctorville man accused of injuring a family after running a stop sign and hitting their minivan broadside has denied the charges.

Houston E. McClung III, 34, of 14542 State Rt. 7, pleaded not guilty in Lawrence County Common Pleas Court Wednesday to aggravated vehicular assault, driving under suspension, operating a vehicle under the influence of alcohol, and failure to obey a traffic control.

McClung’s alleged victims, three children and two adults, were all taken to the hospital following the accident, in which the vehicle rolled several times. One of the family members, an infant, was admitted to the hospital, Assistant Prosecutor Mack Anderson said. Had the children not been in car seats, they would have been killed, Anderson said.

Judge Charles Cooper set a pretrial in the matter for Nov. 17. Cooper continued a $15,000 bond from a lower court.

Also in court Wednesday, Richard Sharp, 47, of 1014 ½ N. Third St., was sentenced to 18 months in prison. Sharp had pleaded guilty in Cooper’s courtroom Sept. 29 to two counts of complicity to trafficking in crack cocaine and two counts of permitting drug abuse.

“I’d like to apologize to the state for my wrongdoings,” Sharp told the court.

Sharp was also ordered to pay court costs, a mandatory fine and his license was suspended.

Judge D. Scott Bowling sentenced John E. Ferrell Jr., 40, of 904 County Rd. 103, Ironton, to three years in prison for his second community-controlled sanctions violation.

Ferrell was tried and found guilty of violating the terms of his community-controlled sanctions by not reporting and testing positive for drugs.

Bowling told Ferrell that he would consider a judicial release to the STAR community justice program in one year if he has good behavior in prison.

Deanna M. Boggs, 20, of 133 Howard St., Coal Grove, pleaded not guilty to corrupting another with drugs. Boggs is accused of ingesting drugs while pregnant. Her child was born severely addicted to drugs, Assistant Prosecutor Brigham Anderson said. Cooper set a pretrial hearing for Nov. 17 and set bond for $10,000 cash or surety and a $20,000 real estate bond.

Sharon R. Ray, 36, of 3690 State Rt. 93, Ironton, pleaded not guilty to patient abuse/neglect, forgery, tampering with evidence and engaging in a pattern of corrupt activity. Bowling set bond at $20,000 cash and set a pretrial hearing for Nov. 17.
