After two years of failing to report for his community-controlled sanctions, a former South Point area man was sentenced to two years in prison Wednesday. Following a CCS trial in Lawrence County Common Pleas Court, Judge D. Scott Bowling found Phillip M. Wallace, 26, guilty of violating the terms of his community-controlled sanctions.

Wallace testified that he suffers from congenital heart failure and moved to Florida to be with family.

“I just wanted to spend to spend time with my family in case I didn’t live any longer,” Wallace said.

Adult probation officer Lynn Stewart testified that Wallace last reported in July 2008 and did not have permission to move to Florida.

Also in court Wednesday, Bowling sentenced Mickey McKenzie, 19, of 3039 S. Ninth St., Ironton, to four years of community-controlled sanctions including the STAR community justice program. McKenzie pleaded guilty to complicity to breaking and entering.

In other cases:

Bowling sentenced Marnie D. Carter, 40, of 1306 S. Fourth St., Ironton, to four years of community-controlled sanctions including the STAR community-justice program.

Carter had previously pleaded guilty to trafficking in drugs and aggravated trafficking in drugs.

James W. Keller, 26, of 929 State Route 775, Proctorville, pleaded guilty to burglary, theft of drugs, grant theft, complicity to grand theft of a motor vehicle, and illegal use or possession of paraphernalia. Cooper will sentence Keller Oct. 20. Keller¹s bond was set at $50,000 on his own recognizance.

Aaron S. Fields, 21, of 104 Remy St., Coal Grove, pleaded not guilty to receiving stolen property, a fifth-degree felony. Cooper transferred Fields’ bond from a lower court.  A pretrial hearing has been scheduled for Oct. 20.

Ashleigh V. Watson, 27, of 615 Tenth Ave., Huntington, W.Va., pleaded not guilty in Cooper’s courtroom to operating a vehicle under the influence of alcohol, tampering with evidence and possession of marijuana. Watson’s $2,500 bond was continued from a lower court. A pretrial hearing has been set for Oct. 27.

Jillian Smith, 28, of 720 Eloise St., Huntington, admitted he violated the terms of his community-controlled sanctions.

Bowling sentenced Smith to successfully complete the STAR community justice program in Franklin Furnace.

Ronnie F. France, 32, of 1618 County Road 144, South Point, admitted he violated the terms of his community-controlled sanctions by testing positive for drugs. Bowling sentenced France to successfully complete the STAR community justice program.

Joey Wilks, 46, of 6248 Beechmont Ave., Cincinnati, admitted he violated the terms of his community-controlled sanctions by failing to pay child support, failing to report to adult probation and by testing positive for drugs. Bowling sentenced Wilks to six months in prison.

Kimberly Donta, 34, of 5724 Windwood Drive, Dublin, pleaded guilty to attempted tampering with evidence and possession of drugs. Bowling sentenced Donta to four years of community-controlled sanctions.
