Cemetery cleanup case continued until December

Judge said owner has cleaned up site
A South Point man who was required to clean up a dumpsite at the cemetery he owns has done so and paid a $10,000 fine, Judge Scott Bowling said Wednesday.
Larry Carter, owner of Highland Memorial Gardens in South Point, was scheduled for a trial Wednesday to face allegations of violating his community-controlled sanctions by failing to clean up the property. That trial was continued for three months until December 15.
“We believe that he’s in compliance with all the orders of the court,” Carter’s attorney Mark McCown said. “It was continued until December so all parties could have opportunity to give input.”
Bowling sentenced Carter to four years of community-controlled sanctions May 25 for an open dumping charge.
Bowling stipulated that he clean up the site or be sentenced to two years in prison.
