The man who was shot by a homeowner as he was allegedly attempting a robbery at the man’s property has been released from the hospital.

Brandon Blake Danner, 18, of Coal Grove, was released from Cabell Huntington Hospital on Wednesday. Originally Danner was in critical condition after he was shot as he was allegedly breaking into a storage shed.

“We are still developing this case,” Lawrence County Sheriff Jeff Lawless said on Thursday. “We are looking to make an arrest within a couple of weeks on several charges pending against Mr. Danner.”

At the time of the shooting Danner was charged with breaking and entering, which is a fifth degree felony.

“The reason we are not arresting now is the prosecutor is determining which charges to be filed,” Lawless said. “Warrants are to be issued in a couple of weeks or (evidence) presented to the grand jury.”

County Prosecuting Attorney Brigham Anderson’s office is reviewing all aspects of the incident, including the shooting.

“All evidence will be presented to a future grand jury either in November or December,” Anderson said.

The name of the homeowner has not been released as the investigation is ongoing and the homeowner fears retribution, the sheriff said.
