Grand jury indicts couple for abuse

A Chesapeake woman and her friend, arrested last month in connection with the abuse of the woman's 4-year-old son,

were indicted this week by a Lawrence County grand jury, according Lawrence County Prosecutor J.B. Collier Jr.

Diana Miller, of 204 Rockwood Ave., Chesapeake, was indicted on two counts of third-degree felony child endangerment and one count of misdemeanor falsification of information.

A friend who lives at the Miller residence, Thomas Overby, was indicted on two counts of second-degree felonious assault and one count of falsification. Overby allegedly provided a fake name to authorities when they began investigating the abuse of the child.

Overby and Miller were arrested Aug. 12 after SEOEMS personnel and employees at a Huntington, W.Va., hospital alerted authorities to the condition of the child. Lawrence County Childrens' Services removed the 4-year-old and three other children from that residence.

A Chesapeake woman arrested in a detailed check scheme was also indicted by the grand jury. Tina Adams, 29, of 1173 County Road 1, South Point,

was indicted on

a second-degree felony charge of engaging in a pattern of corrupt activity, three counts of fifth-degree felony theft by deception, one count of fourth-degree felony grand theft by deception, four counts of fifth-degree felony forgery, one count of fourth-degree felony identity fraud and one count of misdemeanor identity fraud.

Adams was arrested in July by Lawrence County Sheriff's deputies after receiving complaints from four of Adams' alleged victims. Sheriff Tim Sexton said at that time that Adams allegedly obtained information of other people, opened bank accounts with a false identity, deposited money into accounts while using stolen checks and then made immediate withdrawals on those accounts, collecting the money. The withdrawals were made before bank officials knew the deposits were fraudulent.

Three people charged in connection with vandalism at Lake Vesuvius earlier this year were also indicted by the grand jury. John Dale Larsen Jr., 24, of 1529 S. Third St., Ironton; Amanda Lunsford, 23, of Ashland, Ky.;

and Jana Turley, 21, of 303 1/2 Depot St., Coal Grove were each indicted on one count of fifth-degree felony vandalism. In April, Wayne National Forest officials alerted authorities that someone had spray-painted graffiti and names across several rocks and the wooden boardwalk beneath the Rock House.

Three Akron men who were indicted in July by a grand jury were reindicted this month. Michael Lewis, 26, Andrea Perkins, a.k.a. Jerry Totts, 57 and Patrick King, 32, were arrested in June on drug charges

and the evidence was sent away for testing and measurement. According to officials with the prosecutor's office, the results of the newer measurement differed from the original

measurement and the new indictments reflect the changes. Each of the three men were reindicted on

one count of first-degree felony possession of crack cocaine, one count of third-degree felony possession of powder cocaine, one count of third-degree trafficking in powder cocaine and one count of first-degree felony trafficking in crack cocaine.

Other indicted were:

4Grady Smith Jr., 34, of 6 Private Drive 2076 County Road 30, Kitts Hill, was indicted on one count of second-degree felony burglary, one count of corrupting another with drugs and one count of first-degree felony rape. The charges stem from two separate incidents. Authorities said Smith allegedly broke into a residence in the Proctorville area on or about July 22. He is also accused of giving a ride

and later giving marijuana to some juveniles, one of whom was a 14- year- old girl he allegedly raped. The second incident occurred Aug. 1.

4 Keith M. Jessie, 28, of 153 Township Road 268, South Point, was indicted on two counts of third-degree trafficking in crack cocaine, two counts of fourth-degree felony complicity to trafficking in crack cocaine and one count each of fourth-degree felony trafficking in crack cocaine, third-degree complicity to trafficking in crack cocaine,

second-degree felony possession of crack cocaine, first-degree felony trafficking in crack cocaine and a misdemeanor count of possession of criminal tools.

4Tammy Woodberry, 38, of 108 Solida Road, South Point, was indicted on one count of second-degree felony possession of crack cocaine and one count of first-degree trafficking in crack cocaine.

4Connell Jessie, 25, also of 108 Solida Road, South Point, was indicted on two counts of fourth-degree felony trafficking on crack cocaine, and one count each of third-degree felony trafficking in crack cocaine, second-degree felony complicity to possession of crack cocaine, first-degree felony complicity to trafficking in crack cocaine.

Keith Jessie, Connell Jessie and Woodberry were all arrested together over the weekend in South Point.

4Randall Witherell, 27, 902 Gary Malone St., South Point, was indicted on one count of failure to report his change of address required for sexual offenders who must register with the sheriff's office. This is a fifth-degree felony.

4Larry Childers, 46, Catlettsburg, Ky., was indicted on one count of fourth- degree felony operating a motor vehicle under the influence of alcohol.

4David Jenkins, 29, 619 Mill St., Ironton, was indicted on one count of receiving stolen property.

There were also 12 secret indictments, most of them either drug related or for criminal non-support.

The grand jury met Monday and Tuesday.
